Terms of Use
1. Agreement
These terms are an agreement between you and the publisher of Ebbora (“Ebbora”, “we”, “us”). They apply to the Ebbora iPhone app and this website. By downloading or using Ebbora you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the app.
2. Health information
Ebbora helps you track alcohol-free days, reflect and practise general coping skills such as breathing, grounding and riding out urges. It does not diagnose, treat, cure or prevent any condition, and it is not a substitute for advice from a doctor, therapist or other qualified professional. Nothing in the app or on this website is medical advice.
Alcohol withdrawal can be serious. Seek medical advice before reducing or stopping alcohol if you drink heavily or daily, or if you’ve had withdrawal symptoms before. Ebbora is not an emergency service and cannot respond to a crisis. The garden, companion and care days are a creative representation of your participation, not a measure of your health.
3. Who can use Ebbora
You must be at least 18 years old, or the age of majority where you live if that’s higher, to use Ebbora. You’re responsible for keeping your device secure; Ebbora’s optional app lock adds a layer of protection but can’t prevent access to an unlocked device.
4. Subscriptions, trials and payments
Ebbora can be downloaded to browse a preview. Tracking, growth, reflections and other features require a paid plan. The plans offered may include:
- Weekly and yearly auto-renewing subscriptions.
- A lifetime one-time purchase that doesn’t renew.
- A 3-day free trial on the yearly plan for eligible new subscribers. Weekly and lifetime plans don’t include a trial.
Prices are shown in the app and in the App Store before you buy, in your local currency, and may vary by country.
All payments are processed by Apple and charged to your Apple ID when you confirm. Subscriptions renew automatically at the same price and for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends. If you start a free trial, you’ll be charged when the trial ends unless you cancel at least 24 hours before. Any unused part of a free trial ends when you buy a subscription.
You can manage or cancel subscriptions anytime in Settings › [your name] › Subscriptions on your iPhone. Cancelling stops future renewals; you keep access until the end of the period you’ve paid for. Deleting the app does not cancel a subscription.
Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com. If we change a subscription price, Apple will notify you in advance as its rules require, and you can cancel before the new price applies. When a plan expires, exporting and erasing your data remain available.
Nothing in these terms limits any rights you have under consumer protection law where you live, including any statutory right to withdraw from or cancel a purchase.
5. Your content and data
Your check-ins, notes, journal and other entries belong to you and are stored on your device (see the Privacy Policy). Because we don’t store them, we can’t recover them if your device is lost, reset or the app is deleted. Please use the app’s export feature or your device backups if you want a copy. Exported files aren’t encrypted by Ebbora, so store them carefully.
6. Your licence and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Ebbora on Apple devices you own or control, for your own non-commercial use, in line with these terms and the App Store’s usage rules.
Please don’t copy, modify, sell or redistribute the app; reverse engineer it except where the law allows; interfere with its security or purchase checks; or use it for anything unlawful.
7. Our content
Ebbora, its name, pixel art, characters, text, sounds and software are owned by us or our licensors and protected by intellectual property laws. These terms don’t give you any rights to them beyond the licence above.
8. Changes to Ebbora
We keep improving Ebbora, so features may change. We won’t take away things your valley has already grown as a way to pressure you. We may stop offering the app in some places or altogether; if we ever discontinue it, we’ll aim to give reasonable notice so you can export your data.
9. Disclaimers and liability
We work hard to make Ebbora reliable, but it’s provided “as is” and “as available”, without warranties of any kind to the extent the law allows, including warranties of fitness for a particular purpose or that it will be error-free or uninterrupted.
To the extent the law allows, we aren’t liable for indirect, incidental, special or consequential losses, or for loss of data, arising from your use of Ebbora, and our total liability for any claim is limited to the amount you paid for Ebbora in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you. Nothing in these terms excludes liability that can’t be excluded by law, such as for death or personal injury caused by negligence, or fraud.
10. Apple terms
If you downloaded Ebbora from the App Store, you also agree to Apple’s Licensed Application End User License Agreement. You and we acknowledge that:
- These terms are between you and us, not Apple, and we (not Apple) are responsible for Ebbora and its content.
- Apple has no obligation to provide maintenance or support for Ebbora.
- If Ebbora fails to meet an applicable warranty, you can notify Apple and Apple may refund the purchase price; to the extent the law allows, Apple has no other warranty obligation.
- Apple isn’t responsible for handling claims relating to Ebbora, including product liability, legal or regulatory compliance, consumer protection, privacy or intellectual property claims.
- You confirm you aren’t located in a country subject to a U.S. Government embargo and aren’t on a U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. General
Ending use. You can stop using Ebbora anytime by deleting it (and cancelling any subscription). We may suspend access to paid features if you breach these terms.
Changes to these terms. We may update these terms from time to time. We’ll change the date at the top, and for significant changes we’ll let you know in the app or release notes. Continuing to use Ebbora after changes take effect means you accept them.
Law. These terms are governed by the laws of the country where the publisher is established, without regard to conflict-of-law rules. If you’re a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims in your local courts.
Everything else. If any part of these terms is found unenforceable, the rest still applies. Not enforcing a term straight away doesn’t waive it.
